Terms and Conditions of Sale and Service
Eccleston Aviation Ltd
These Terms and Conditions apply to the supply of all goods and services by Eccleston Aviation Ltd (“the Company”). By placing an order, commissioning work, or accepting delivery, the Customer agrees to be bound by these Terms.
1. Definitions
- Customer – the customer, organisation, or aircraft owner purchasing goods or services.
- Goods – any components, parts, or equipment supplied.
- Services – maintenance, inspection, repair, overhaul, installation, or technical support.
2. Quotations and Pricing
All quotations are valid for 14 days unless otherwise stated.
Prices are based on the information available at the time of quotation. If additional work becomes necessary that could not reasonably have been anticipated, the Company will seek Customer approval before proceeding where practicable.
Prices may exclude shipping, insurance, customs charges, and applicable taxes unless stated otherwise.
3. Supply of Goods
Goods are supplied in accordance with manufacturer specifications where applicable.
The Customer is responsible for ensuring suitability for the intended aircraft, engine, or installation.
The latest manufacturer manuals, service instructions, and regulatory requirements must always be consulted prior to installation.
Installation should be performed by appropriately qualified personnel.
4. Airworthiness Responsibility
The determination of airworthiness remains solely the responsibility of the aircraft owner, operator, and/or licensed engineer responsible for the aircraft.
Eccleston Aviation Ltd supplies goods and services using available manufacturer data but does not certify the airworthiness of any aircraft, component installation, or system unless explicitly stated in writing.
5. Installer and Operator Responsibility
Incorrect installation or misuse of aircraft components can result in equipment failure. The Customer and installer are responsible for:
- verifying compatibility
- following manufacturer procedures
- ensuring correct torque settings and adjustments
- completing required inspections
- complying with regulatory requirements
- ensuring the engine is correctly set up and maintained, including carburettor balance and propeller balance, so as to avoid excessive vibration
Sensors and senders mounted directly to the engine are particularly sensitive to mechanical vibration. Premature or intermittent failure is frequently caused by excessive engine vibration arising from incorrect engine setup, poor carburettor balance or a propeller that is out of balance, rather than by a defect in the component itself. Such vibration wears the internal mechanical drive of the sensor over time. Responsibility for maintaining the engine to manufacturer specification in order to avoid excessive vibration rests with the Customer and installer, and is addressed further under Clause 10 (Warranty).
6. Service Bulletins, Airworthiness Directives, and Modifications
Compliance with service bulletins, manufacturer updates, or airworthiness directives will only be undertaken when specifically requested or where legally required for work being performed.
The Customer is responsible for monitoring ongoing compliance status.
7. Engine and Component Installations
Due to the wide variation in aircraft configurations, the Company cannot verify every installation scenario.
Responsibility for ensuring compliance with the aircraft approval basis rests with the Customer and installer.
8. Scope of Service Work
Service schedules vary depending on engine type and operating conditions.
Airframe-related items may fall outside the scope of engine servicing unless agreed in writing.
9. Post-Service and Pre-Flight Responsibility
Following maintenance or installation, the Customer must ensure that appropriate inspections, ground runs, and operational checks are completed before flight.
Manufacturer documentation always takes precedence.
10. Warranty
10.1 Workmanship
Workmanship on services carried out by the Company is warranted for 3 months or 50 engine operating hours from completion, whichever occurs first, unless otherwise stated.
10.2 Electrical Components and Senders – Company Warranty
Electrical components and senders supplied by the Company (including but not limited to fuel senders, sensors, wiring looms, connectors, and switches) are warranted by the Company for 3 months from the date of supply or installation, whichever is later, irrespective of hours flown.
This warranty covers failure arising from a genuine defect in the component itself. It does not cover failure caused by excessive engine vibration, wear, or fatigue resulting from incorrect engine setup, poor carburettor balance or a propeller out of balance, or servicing not carried out in accordance with manufacturer guidance. Where a sender or sensor fails and the Company reasonably determines the cause to be engine vibration or a setup-related issue rather than a component defect, the warranty in this clause does not apply, and Clause 5 (Installer and Operator Responsibility) governs instead.
10.3 Manufacturer Warranty
Certain components, may separately carry the original manufacturer’s warranty, typically 1 year or 100 operating hours from installation, whichever occurs first. This manufacturer warranty is provided and assessed by the manufacturer on its own terms and is separate from the Company’s 3-month warranty at Clause 10.2. The Company will assist in referring a claim to the manufacturer where appropriate, but cannot guarantee the outcome of any manufacturer assessment.
As with the Company warranty, manufacturer warranty cover does not extend to failure caused by excessive engine vibration arising from incorrect engine setup, poor carburettor balance or propeller imbalance, as such wear is not a component defect.
10.4 General Warranty Terms
The Company’s liability under warranty is limited to repair or replacement at its discretion.
Warranty is void where:
- installation was not performed correctly
- manufacturer procedures were not followed
- components were modified
- third-party interference occurred
- the product was misused
Goods are subject to the original manufacturer’s warranty where applicable.
Nothing in this clause affects the Customer’s statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.
11. Returns Policy
Returns are accepted only with prior authorisation.
Unused goods may be returned within 14 days of delivery, provided they are:
- unused
- uninstalled
- in original packaging
- in resalable condition
The Company reserves the right to apply a restocking charge where appropriate.
For safety reasons, the Company cannot accept returns of components that have been installed, attempted to be installed, electrically connected, fuel exposed, torqued, or otherwise altered.
12. Distance Selling (UK Compliance)
Nothing in these Terms affects the statutory rights of consumers under applicable UK law.
However, the right to cancel may not apply to goods:
- manufactured to order
- specially sourced
- safety-critical aircraft components where traceability has been affected
13. Limitation of Liability
Nothing in these Terms shall exclude or limit liability for:
- death or personal injury caused by negligence
- fraud or fraudulent misrepresentation
- any liability that cannot legally be excluded
Subject to the above:
Eccleston Aviation Ltd’s total liability shall not exceed the purchase price of the goods or services supplied.
The Company shall not be liable for indirect or consequential losses including:
- loss of use
- loss of revenue
- operational downtime
- third-party damage
- aircraft recovery costs
14. Acknowledgement of Mechanical Risk
Aircraft and high-performance engines contain mechanical components subject to wear and potential failure.
Proper installation, inspection, maintenance, and operation in accordance with manufacturer guidance are essential to safe operation.
By purchasing goods or services, the Customer acknowledges these responsibilities.
15. Force Majeure
The Company shall not be liable for delays or failure to perform caused by events beyond reasonable control.
16. Governing Law
These Terms shall be governed by the laws of England and Wales.
